    This could be one side of story. There were other posts which was mentioning about some fake resumes given by some Indian consultancy companies. So all those are isolated cases and we cannot take into account. I am seeing lot of hard working Americans and Indians as well. Also a family person with 2 kids cannot spend 12 or 16 hours per day compared to Bachlors(Most of the Bachlors who are spending 12 to 16 hours are H1b persons). If assesment is done based on that then that does not make any sense. Then do you thinkyou need to fire more than 35 year Old people and recruit 25 year people That is not American way. This country for long time Top rankholders as well as school dropouts also could survive and Lead a decent quality of life. I knew lot of Indians most of them gc holders and some H1b also those who were just average in skills had tough time in getting job between 2000 to 2004 because of more number of H1B people and also economy was bad. So there is no surprise some Americans also might have similar situation. But past 2 years everybody I knew were able to get job and survive well. This is because of economy and also because of limited H1b. But Corporations are asking too much h1b(unlimited by 20% automatic increase every year and exemption for PhD/MS people). Certainly that will kill the demand in job market and bring down the rates. I think H1B increase should be compromise between demand and supply. Otherwise there is going to be huge opposition. Congress cannot only favor Business. But as a Senator they have to take care of all groups of people. There may be a possiblity that H1b increase may happen but EB relief may not happen not that much strong lobbey from Business compared to H1B. American companies lie Micosoft, Intel culd not get H1B people because Indian consultancy companies grabbed all the H1bs in first few weeks of April and May not because of numbers. So that is a differentind of problem


    Is there something we can do to lobby against unbridled H1B increases?

    Maybe make a deal with our friends on the other side of the fence to lobby together for placing a sharp limit on H1B increase, especially without a corresponding increase in immigration numbers. Combine that with a speedup in eliminating the current backlogs. After all, the worst case scenario for them isn't flooding of H1B's in the market, but those H1B's already here & stuck at low wages and performing at the job levels of highly experienced techies simply because they are stuck because of mobility issues after 6 yrs of H1B.

    It's easy to see that any increase in H1B without clearing the EB pipe will lead to a larger workforce of experienced and exploited workers driving the 5 - 10 year experienced folks wages lower. On the other hand, if the current EB backlog is cleared with very carefully calibrated H1B increases (maybe increase the number of visas for MS folks from the current 20K to 40K or something to relieve the current hiring inability businesses claim to have) would let the tons of people currently stuck to be free to move about and drive the wages up. This is what Numbersusa etc are hoping to see...

    We are doing this to help everyone. Especially, those whose PD is still current as per September VB, if you act with in next 5-10 days, you have a chance. if you can individually file a law suit when your PD is current.Since my guess is, the lawsuit we are working on in this thread, will take some time to shape up. But this is a Biggie, we want to create a big impact. Meanwhile, folks who are out there waiting since 2001,2002.... you can follow the links that i pasted in my previous message. People have won lawsuit very similar to the one we are talking about. I can even paste some of the I-485 lawsuits filed because of unreasonable and unnecessary delays, when PD is current.

    I am not saying that this is a case on employers. If at all it would be a case against the discriminatory laws of the congress which allow someone to stay indefinitely but, do not allow them to work.

    From legal point of view, you are incorrect.

    What do you mean by "not allow them to work"? Actually AC-21 weaken the case you are mentioning. Since pending/approved I-140 allows extension of H-1 indefinitely, that alone takes your point away.

    When I was on H-1, that time one couldn't extend beyond 6 years, no matter what. Now, case is much different. There are so many working for the employer just on the basis of I-140 alone after 6 years of H1.

    Unfair does not always mean illegal.

    Agreed. $5000 is about the same amount a single student paid to TVU, the diploma mill. This used to be the price 1 employee paid a fraud DCC for processing a Green card.

    Sanju my friend, why sarcasm ? This is such wonderful information, why can't this be made more public, posted in a prominent position on IV ? Why should members do research to get this info when it can be relatively easily acquired by Quinn Gillespie & Assoc and given to core ? Come on man, a little bit of information like this goes a long way with members.

    qasleuth, I don't believe that suri is for real. I think this guy is phony and will not spend a dime on anything other than his selfish self. I don't know why core or admins here do not give out this information, you could ask them, but I do know that folks here should grow up and be mature not scared to do their own research, because the best thing we can do for ourselves is, research and gain knowledge. I did a simple google search and within 5 minutes I found this information. So if someone wants to find information, there is no scarcity of relevant information online. The problem is, some folks don't want to move their fingers to do simple google search, but they have all the time in the world to find reasons to sit on their a$$ and not do anything. And that's just too much bull....

    Tell this suri guy to go tell his friends that the EADs they flash every time allay their anxiety is because I and others like me paid for it. So I have earned and paid for the right to sarcasm with these elite educated illiterate idiots, if you know what I mean.

    being anguished about the situation of not getting receipts and even worse - not being able to track or check status...I emailed the attorney and asked if he could check for encashed checks or if their firm is getting july 2nd receipts...
    His response :

    "We have just started getting receipts for some of the June applications we sent. I am surprised that July filers are already getting their receipts and somehow find it hard to beleive thats the case. Anyhow we have no updates on ur case."

    I agree. Something strong needs to happen for EB3(I). I personally never have seen any difference between the pain felt by EB2 and EB3, ROW or I. Everyone feels the same pain waiting for their GC. But the prospect for EB2 atleast looks better. For EB3 it looks gloomy as always.

    If there is a lawsuit, then it should be for all, not just for EB3.

    My friend filed on July 2nd to NSc..she called the level 2 support and they said that her information is still nto in the system and that they are busy with lot of applications and asked her not to worry...

    I applied on August 2nd and still nothing....

    Donno how long we need to wait for?

    Just a thought..Why not request all our GC/citizen friends to also attend?

    If you are able to file gc why do you need this. Only future H1bs need to bother about the this restriction. Corporations or Compete America will lobby to remove H1b restrictions if that creates problem for them.

    I am about to e-mail to the Senators based on the new letter.

    Folks, but I have a simple question. Is the following provision addressed by IV when contacting the Senators or not ?

Instead of this bullshit, his priority must be to get better and spend time with family and friends. We dont know how things will be after 6 months. What I find retarded is that this crap green card seems to be taking higher position than him getting better.

    To the original poster: Please realize that there is nothing more beautiful than life. Every minute of it is of the essence. Family and loved ones are more important than anything in life. You will not take money, green card or anything after you die. Your wife will be more happy realizing that she spent some fantastic time with you. I wish and pray that you get better.     What exactly is the point of this rambling debate? Does anybody really thinks he/she can make an EB2 see the point of view of EB3 or vice-a-versa? No amount of legal/moral/philosophical arguments is going to convince the other party and we all know it.

    All this debate has done is to bring out the ugliest side of all of us to the surface. There are EB2s claiming every EB2 is by definition superior than EB3 which is insane. And there is an EB3 who is itching to take help of none other than Ron Hira to shot down somebody's GC application as a retribution and couple of people applauding him for the brilliant idea! Really? Do we really thinks this is such a grand idea?

    Just accept that everyone's only guiding principle here is self interest and move along. No need to jump through hoops to interpret the immigration law in 101 different ways and no need to call attention to personal suffering and plight. If we do really believe personal suffering should take precedence over everything else on humanitarian grounds then lets all first fight for illegal immigrants since their suffering is much worse than anyone here!

    EB3s, go run your campaign and stop trying to appeal to EB2's sense of justice. That will never happen.

    EB2s, stop trying to expect EB3s will accept higher EB preference categories should in fact get preference over the lower ones. That will never happen.

    The only thing we all can hopefully agree on is, if there is anyone here - doesn't matter EB2 or EB3- who is fiercely debating this but has never contributed to IV and has never participated in any of the previous IV action items in the past that person should just shut up! If you were never active in IV you shouldn't really be talking at this point!!

    I actually got this input of contacting congressman to implement this change, from USCIS only(their blog). I will also contact the ones mentioned in your posting. I also request all EB folks affected by this spillover usage not based on priority date, to contact them in addition to their local congressman. Let's not leave any stone unturned to make this happen, to help us all out. If this happens soon to create an impact, we may see some light in the upcoming bulletins. So all of you please do your part to contact them today(if not done already), I am on it now.

    If we go with your feeling, and run the Campaign right way then following is summary.

    1) What you mentioned was there is no need to Legislative change for your solution only Interpretation of INA need to be changed challenged.
    2) EB3 Folks want only on using Fall Across / Down /UP visa's to be allocated based on PD, rather then category.
    3) Removing Country quota will need legislative change and EB3 folks don't want to take it on hand at this time.
    4) You and EB3 folks are good with division created by this Campaign.

    Now, If above summary is true then You need to be doing following,
    1) READ INA and Find where is violation or Incorrect interpretation in Applying VISA to EB2.
    2) You need to be contacting DOS - Mr. Charles Oppenheim / Hillary Clinton their 2007 interpretation of Applying VISA to EB2.
    3) You need to be contacting DOS Liaison to Challenge their 2007 interpretation of Applying VISA to EB2.
    4) If EB3 Guys are confident of incorrect INA interpretation, collect Money and Prepare for Law-Suit if needed.
    5) As there is no Legislative changes needed, there is no need to contact Law makers (Senators, House members).
    6) There is no Process improvements so no need to reach out to USCIS ombudsman.
    7) Its About VISA allocation by DOS, so contacting USCIS won't help either.
